How could the rights of rainbow families in the EU be further strengthened? This is a question that not only concerns the community, but also politics. One person who is currently particularly committed to the community and is speaking out accordingly is Marco Buschmann from the FDP. He wants the ruling that was recently passed by the European Federal Court of Justice to be implemented throughout the EU.

Not everyone is likely to be enthusiastic about this. After all, the initial situation in various EU countries, for example, is completely different from that in Germany.

More rights for rainbow families

What exactly is Bushman calling for rainbow families?

Marco Buschmann is currently advocating, among other things, that parenthoods that have been officially recognized in one country of the EU should also be automatically recognized in the other countries of the European Community. In this context, no distinction should be made between hetero and homo partnerships.

Bushman defines the whole thing even more precisely in the next step by stating that, in his opinion, it is important that each country should be allowed to decide what counts as a family. At the same time, however, decisions made in this context by one EU country should be accepted by the others.

"Modern family forms" should not be excluded in this framework. Families, regardless of whether the children grow up with same-sex parents, for example, must be able to use their freedom in the EU area.

More than "just" tolerance

Anyone who takes a little time to look at the subject in more detail will quickly realize that there is more at stake here than the emotional component and the desire for more equality.

For example, if a rainbow family decides to move within Europe from a country that is tolerant towards them to a country that restricts the rights of queers, this could cause a lot of problems. In the worst case, children would also suffer from this, as there could, for example, be complications with registering in the respective school of choice, etc. This is exactly what the more general(and tolerant) rules are meant to prevent.

What did the European Court of Justice decide?

The message brought to the world by the European Court of Justice ruling was clear: more rights for rainbow families. They should be able to move more freely and without restrictions in the EU.

At the same time, the traffic light coalition also decided to strengthen the rights of queers and families with same-sex parents. This became particularly clear with regard to rainbow families with two mothers. Here, the wife of the natural mother is from now on to be automatically considered the second parent. In the future, this right is to apply not only to married couples, but also to same-sex unmarried couples.

Not all EU countries are likely to be enthusiastic...

It is no secret that opinions on how many rights queers should be granted differ significantly in some cases within the EU. The situation of the community is particularly tense in Poland and Hungary. Here, politicians are always railing against the scene. Also unforgotten: The LGBTQI+ free zones in Poland and the homophobic statements of Victor Orbán.

However, it is also clear that both countries belong to the EU, even if they cannot identify 100 percent with its values. Accordingly, based on the ruling of the European Court of Justice, they will have to come to an arrangement sooner or later.
