Italy recognizes a non-binary person for the first time

Many people are already talking about a kind of caesura. For the first time ever, a court in Italy has decided to recognize the identity of a non-binary person. Alex was represented by the lawyer Giovanni Guercio and can claim this very special success for himself.

After all, not only he but also the community can be happy about the hope for more equality.

The current ruling could be trend-setting in that it is something of a premiere - at least for Italy. The ruling also has a special impact. The recognition means, among other things, that a non-binary person - especially with regard to his rights and equality within society - could have a greater chance of no longer being exposed to discriminatory procedures in the event of a possible name change.

Attorney Guercio was also quite relieved. He explained in an interview with the site Gay.it that he hoped that now many other queers in the country could also benefit from this particular judgment.

To what extent the current legislation on this subject will be changed is not yet clear. However, it is a small step in the (for many) right direction. In this context, it was of course particularly touching that the judge in charge also showed himself emotionally and made no effort to hide the fact that the verdict also caused him joy.

Probably people who are not in the same or a similar situation cannot understand how Alex must have felt.
According to his lawyer's account, he was so overwhelmed that at first he could only say thank you. After all, after what must have been a nerve-wracking process and a lot of trembling, he has succeeded in taking what is probably one of the most important steps toward self-determination.

What is the current situation in Germany?

There is also a lot going on in the social networks at the moment under the hashtag "#selbstbestimmung". In this country, too, it is made difficult for many people to change their gender - if they want to.

One law that plays an important role in this context is the TSG, the so-called transsexual law. If everything works out, the self-determination law should take its place. This could also mean a special kind of freedom for many affected people, among others transsexuals and non-binary people. Because: Who was born in the wrong body today and would like to have his personal status adjusted in the identity card, must undergo a - in many parts - discriminating procedure. Among other things, questions about sexuality are asked as part of a total of two expert opinions.

Many people are striving - sometimes also with petitions - to change exactly that. They would like to achieve that in the future it no longer needs a judicial verdict to have one's gender adjusted. It would then be sufficient to go to the registry office in order to be able to stand by oneself a little more.

Will everything now be different in Italy, too?

As encouraging as the news may sound that a non-binary person has now been recognized in Italy for the first time, it would certainly be a bit naïve to assume that complete equality can now be spoken of. In order to be able to provide a sound basis for the recognition of gender definitions, apart from the cis norm, the first step would be an adapted legislation. And until this is finally brought on the way, it might still take a little while... .
